These Terms and Conditions ("Terms") govern your access to and use of PaymentForm.io ("the Service"). PaymentForm.io is a product operated by Shopper Form LLC, a Wyoming limited liability company (“we,” “us,” or “our”). By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

"Service" refers to the PaymentForm.io platform, including all features, tools, and pages accessible at paymentform.io.
"User" or "you" refers to any individual or entity that registers for or uses the Service.
"Form Owner" refers to a User who creates payment forms using the Service.
"Respondent" refers to a person who fills out and submits a payment form created by a Form Owner.
"Free Plan" refers to the no-cost tier of the Service with limited features as described on our pricing page.
"Paid Plan" refers to any subscription tier requiring payment.
"Content" refers to any text, images, data, or information submitted to the Service by a User.

2. Eligibility

You must be at least 18 years old to use PaymentForm.io. By using the Service, you represent and warrant that you have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration

To use PaymentForm.io, you must create an account by providing accurate and complete information. You are responsible for:

Keeping your login credentials confidential
All activity that occurs under your account
Notifying us immediately at support@paymentform.io if you suspect unauthorized access

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Free Plan and Paid Plans

Free Plan

PaymentForm.io offers a free plan with access to core features. The free plan is provided as-is, and we reserve the right to modify, limit, or discontinue it at any time with reasonable notice.

Paid Plans

Paid plans are billed on a recurring basis (monthly) or onetime payment. By subscribing to a paid plan, you authorize us to charge your payment method at the start of each billing cycle.

Cancellations

You may cancel your subscription at any time from your account settings. Your access to paid features will continue until the end of the current billing period. We do not provide refunds for partial billing periods unless required by applicable law.

Price Changes

We reserve the right to change subscription pricing. We will give you at least 30 days' notice before any price change takes effect. Continued use of the Service after the notice period constitutes acceptance of the new pricing.

5. Acceptable Use

You agree to use PaymentForm.io only for lawful purposes. You must not use the Service to:

Collect payments for illegal goods, services, or activities
Run fraudulent campaigns, scams, or impersonate another person or organization
Collect payment information deceptively or without disclosing the nature of the transaction
Distribute malware, spam, or any harmful code through your forms
Violate any applicable local, national, or international law or regulation
Harass, threaten, or harm any individual
Attempt to gain unauthorized access to our systems or another user's account

We reserve the right to suspend or terminate any account that we determine, at our sole discretion, violates these Terms or is being used for harmful purposes.

6. Your Responsibilities as a Form Owner

As a Form Owner, you are solely responsible for:

The content of your forms, including the accuracy of descriptions, pricing, and terms
Fulfilling any obligations to Respondents who complete a payment through your form (delivery of goods, services, tickets, etc.)
Ensuring you have a legal basis to collect personal data from Respondents
Complying with applicable consumer protection, data protection, and financial regulations in your jurisdiction
Any disputes, refunds, or chargebacks initiated by your Respondents

PaymentForm.io is a form-building and payment facilitation tool. We are not a party to any transaction between you and your Respondents. All payment obligations, fulfillment responsibilities, and legal compliance rest with you.

7. Third-Party Payment Gateways

PaymentForm.io integrates with third-party payment gateways, including Stripe, PayPal, Razorpay, Mollie, and Square. To accept payments, you must create and maintain an account with at least one of these providers.

All payment processing is governed by the terms and policies of your chosen gateway. We are not responsible for gateway downtime, transaction failures, holds, or disputes imposed by your payment provider.

PaymentForm.io does not store, process, or transmit cardholder data. We are not responsible for the security of payment information handled by third-party gateways.

8. Intellectual Property

Our Platform Materials

All software, design, code, branding, and content that make up the PaymentForm.io platform are the intellectual property of PaymentForm.io. You may not copy, modify, distribute, or create derivative works from any part of the platform without our written permission.

Your Content

You retain ownership of all content you upload or create using the Service. By using PaymentForm.io, you grant us a limited, non-exclusive license to store, display, and process your content solely to provide the Service to you.

Feedback

If you submit suggestions or feedback about the Service, you grant us the right to use that feedback without any obligation to compensate you.

9. Data and Confidentiality

We handle your data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and agree to our Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PAYMENTFORM.IO DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not guarantee that the Service will meet your specific requirements.

11. Indemnification

You agree to indemnify and hold harmless PaymentForm.io, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:

Your use of the Service
Your forms and the transactions conducted through them
Your violation of these Terms
Your violation of any applicable law or third-party rights

12. Termination

You may close your account at any time by contacting us or using the account settings. We may suspend or terminate your account at any time if we believe you have violated these Terms, with or without prior notice, depending on the severity of the violation.

Upon termination, your right to access the Service ends immediately. We may retain certain data as required by law or for legitimate business purposes as described in our Privacy Policy.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Bangladesh, without regard to conflict of law principles.

Any dispute arising from or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to the competent courts of Bangladesh.

For users located in the European Union, nothing in these Terms limits your rights under applicable consumer protection laws in your country of residence.

14. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and PaymentForm.io regarding the Service.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights to a successor in connection with a merger or acquisition.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and update the "Last Updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

If you do not agree with the revised Terms, you should stop using the Service and cancel your subscription before the changes take effect.
